An Oviedo police officer has been charged with shooting into an occupied vehicle and two counts of aggravated battery after firing his gun at a suspect revving his engine at him in September, according to the Seminole County State Attorney’s Office.
Matthew Danler, 37, was responding to a call for help in the 900 block of Sharon Court on Sept. 1 when he and other officers approached a vehicle. The driver revved his engine and drove around the police vehicle “in an aggressive manner directly at [Danler],” the Oviedo Police Department said after the incident.
“The aggressive actions of the suspect caused the life of the officer to be in immediate jeopardy, resulting in his use of deadly force,” Oviedo police said at the time.
A grand jury indicted Danler on Tuesday after hearing testimony from a Florida Department of Law Enforcement agent and two witnesses to the incident, according to the State Attorney’s Office.
“This was a difficult case. Whether or not an officer is justified in an on-duty shooting is of tremendous public importance and I felt that in this case it was important to have input from the community through the Grand Jury,” State Attorney Phil Archer said in a news release Tuesday.
Danler turned himself in to the Seminole County Jail after the indictment, the State Attorney’s Office said. If convicted, he could face up to 15 years in prison for each charge.
After the shooting, Danler was reassigned to desk duties. The driver survived.
