A federal judge has declined to dismiss a federal class-action lawsuit filed on behalf of residents who claim the toxic pollution of water supplies in and around Hoosick Falls diminished the value of their properties and put them at increased risk for certain diseases, including cancer.
In a 39-page decision filed late Monday, U.S. District Court Senior Judge Lawrence E. Kahn struck down the central arguments made by attorneys for two companies — Saint-Gobain Performance Plastics and Honeywell International — blamed for the pollution, and who filed motions seeking dismissal of the lawsuit.
Kahn’s order also gave the companies the ability to immediately request leave from the U.S. Second Circuit Court of Appeals in Manhattan to review the decision.
