A Pinellas circuit judge declared a mistrial Friday in the trial of a St. Petersburg man charged with shooting a friend 25 times.

When prosecutors in the case asked a witness how long he had known the defendant, Oscar Fowler, the witness said he had known Fowler since he was released from prison.

"A defendant’s prior criminal history is not supposed to be alluded to," said Pinellas courts spokesman Stephen Thompson.

A new trial date will be scheduled on Monday.

This was the second time Fowler has been on trial for the murder of Naykee Bostic. In 2015, his first trial ended in a hung jury after jurors deliberated for six hours.

On the morning of July 28, 2013, St. Petersburg police found 31-year-old Bostic’s body behind 1803 Beach Drive SE. Through cellphone tower data, investigators determined Bostic and Fowler had been in the same area at the time of the shooting.

Fowler faces a charge of first-degree murder. If convicted, he faces up to life in prison.
