The Labor, Inclusion, Social Security and Migration Commission will debate this Monday the Employment Law, through which PSOE and Unidas Podemos intend to reform the Workers’ Statute to declare the Minimum Interprofessional Wage (SMI) unattachable, both in its “monthly” amount as annual”.

After passing its phase in presentation, the commission will deliberate this amendment of the coalition partners to the bill, which aims to end an ambiguity regarding the attachable accrual periods of the SMI. Specifically, PSOE and Podemos argue that the current legal or regulatory norms that include the absolute indefeasibility of the SMI do not specify specific amounts.

In this sense, socialists and ‘purples’ propose a modification that leaves “clearly manifest” the indefeasibility of the amount equivalent to the SMI, whatever the form of its computation, the nature of the remuneration to which it is applied or the period of accrual, given that “it complies with the constitutional function of attending to the minimum needs”.

The norm, processed by urgent procedure to reduce by half the ordinary deadlines for its preparation and approval, faces this new parliamentary process after passing an amendment to all of Vox.

In fact, in the first instance there were two amendments to the total return registered, from the PNV and from Vox. However, PNV chose to withdraw the amendment, while Vox went ahead with it. However, it was debated in the Plenary of the Lower House, where practically all of Congress voted against Vox’s proposal.

The Council of Ministers approved the law on June 21, ensuring that it is a framework standard for public employment policies that will allow workers to have “new and more effective” tools to improve guidance and support both for job search and to improve their employability.

As the Government explained at the time, the pillar of the new standard is personalized support for people who will be guaranteed a Common Portfolio of Services. Thus, an individualized profile of the worker will be drawn up, who will receive individual and continuous tutoring and for which a personalized itinerary will be drawn up.

One of the main innovations introduced by this law is the transformation of the State Public Employment Service into the new Spanish Employment Agency. As explained by the Government, this change “will make it possible to improve its management and operation without involving an economic charge to the public treasury.”
