The National Commission for Markets and Competition (CNMC) has published a resolution certifying compliance with the conditions imposed on Red Eléctrica de España (REE) and its subsidiary Red Eléctrica Infraestructuras de Telecomunicación (Reintel) in its legally binding decision on the contracts for the assignment of the right to use fiber optics, of July 15, 2021.
In said decision, the CNMC agreed on various actions to be carried out by REE and Reintel to guarantee the safety of the electricity transmission system.
Among them, they had to introduce various clauses in the assignment agreements to guarantee the operation of the transmission network and the priority of the electrical service, and they had to send the agency the pertinent documentation to prove the realization of said changes and any others that might take place. in the future.
In addition, it was required to provide more information on the costs generated by this intra-group operation, since conditions were established to ensure that said costs did not have any impact on transport remuneration.
According to the body chaired by Cani Fernández, REE and Reintel have carried out the required actions to date, having been accredited through contributions of the documentation required on September 30, 2021, January 14, 2022 and July 13, 2022, complying with the deadlines set out in the legally binding declaration.
Thus, with the information submitted, and with that reported by REE, it is verified that the second, third and seventh agreements of the legally binding decision have been complied with. Likewise, up to the present date, the fifth and sixth agreements of the legally binding decision have been complied with.
However, and given that these agreements have a continuous scope over time, the CNMC points out the need for REE and Reintel “to continue observing the information obligations contained therein when the foreseen circumstances occur.”
