Amazon’s Anti-Counterfeiting Crime Unit (CCU) and the BMW Group have won a joint civil lawsuit, the first of its kind in Spain, that they filed against four local counterfeiters who attempted to sell Amazon parts and accessories. the German automobile firm counterfeited throughout Europe.
The ruling of the European Union (EU) Trademark Court of Alicante has ruled “that the defendants violated the law (including infringement of the BMW group’s trademarks) and also Amazon’s policies by trying to sell counterfeit products, such as lids of valves, badges and key chains”.
Amazon detailed this Thursday in a press release that it has “proactive” measures to detect and prevent counterfeit products from being offered in its stores and that it “continuously monitors its website to prevent these crimes.”
In this case, Amazon detected “suspicious” activity using advanced machine learning tools and worked closely with the BMW group to confirm that the products in question were counterfeit.
Amazon then took action against the defendants’ seller accounts, removing products related to the case and refunding affected customers.
Amazon’s CCU, created to identify and dismantle counterfeiting organizations, always worked in “close” collaboration with the BMW group, filing a joint lawsuit against the offenders.
The director of Amazon’s CCU, Kebharu Smith, has highlighted that this ruling “is a very important victory”, while the director of the department of Intellectual Property, Brands and Designs of the BMW group, Jochen Volkmer, has stated that they hope to continue with this collaboration.
