Madrid, October 16
The reasons for his insolvency are personal over-indebtedness and the reduction of his economic capacity due to the situation in the labor market.
Repara tu Deuda Abogados, the leading law firm in Spain in the processing of the Second Chance Law, has achieved a new debt cancellation in Madrid. Through the management of Repara tu Deuda Abogados, the Court of First Instance No. 12 of Madrid has issued the Benefit of Exoneration of Unsatisfied Liabilities (Bepi) in the case of a woman who had accumulated a debt of 25,565 euros that she could not meet . SEE JUDGMENTAs the lawyers of Repara tu Deuda explain, “the facts from which his situation of insolvency derives are a personal over-indebtedness and a significant reduction in his economic capacity due to the situation in the labor market. For this reason, he decided to start the process to benefit from the Second Chance Law. Now you have its cancellation and can start a life free of debt.” According to Repara tu Deuda, “Spain was one of the countries in the European Union that took the longest to incorporate into its system the Second Chance Law, a mechanism provided for the cancellation of the debt of natural persons, including at this point the self-employed. Since September of last year, with the reform of this tool, it is not necessary to try to reach an agreement extrajudicial payments with banks and financial entities”. Approved in 2015, there are still many people who are unaware of the existence of this legal tool. Despite this, there are already more than 20,000 individuals and self-employed people who have put their history of over-indebtedness in the hands of the law firm to reactivate themselves in the economy, be able to access new financing and also get off the delinquency lists such as ASNEF. Repair Your Debt was created precisely in 2015. Since then until now it has managed to exceed the figure of 170 million euros exonerated to its clients, from the different autonomous communities. It is expected that this figure will continue to increase as a result of the high number of queries received daily and because more people have learned about this tool. It is also important that many of those exonerated tell their story of over-indebtedness and subsequent satisfactory outcome of their process. This legislation protects individuals and self-employed workers if they meet a series of requirements. In general terms, it is sufficient that the bankrupt does not exceed 5 million euros, that he has not been convicted of socioeconomic crimes in the last ten years and that he acts in good faith, without hiding assets or income. For people who cannot attend to the Second Chance Law, the office also offers them the possibility of analyzing the contracts signed with banks and financial entities. The objective is to check if there are abusive clauses to try to cancel credit cards, revolving cards, mini-credits, loans and mortgages when complaining to Cofidis, Moneyman, WiZink, Carrefour, Vivus, Banco Santander, CaixaBank, BBVA, Banco Sabadell, myKredit, Kviku , etc.
