The woman asked for a reduction in working hours to help her daughter, who was experiencing a high-risk pregnancy
The Court of First Instance No. 6 of Móstoles (Madrid) has issued the Benefit of Exoneration of Unsatisfied Liabilities (BEPI) in the case of a woman who has thus been exonerated from a debt of 72,656 euros. The case has been processed by Repara tu Deuda Abogados, the leading law firm in Spain in the Second Chance Law. SEE JUDGMENTAccording to the lawyers of Repair your Debt, “his state of insolvency originated because he reduced his working hours to help his daughter due to a high-risk pregnancy. This situation worsened because his partner was left without a job and had to With his income, he accepted all the household expenses. For this reason, he accepted the credit cards offered by the different financial institutions to make ends meet, with the purpose of being able to pay it little by little. However, a moment came in which his economic situation was unsustainable, being unable to meet the quotas and his essential expenses”. As in his case, many people turn to the Second Chance Law after having tried in different ways to solve their economic problems. They do so by having suffered a series of personal and/or work circumstances that have not been sought. In this sense, it should be noted that the Second Chance Law came into force in Spain in 2015 to help them. Since its approval, more than 20,000 individuals and the self-employed have placed themselves in the firm’s hands to cancel the debts they have contracted and that they cannot assume.Repara tu Deuda Abogados is the leader in Spain in the application of the Second Chance Law. Since it was created in September 2015, the office has managed to exceed the figure of 130 million euros in debts to people who come from the different autonomous communities of the country and who have come out of the situation of anguish in which they found themselves. To offer confidence to those who are also requesting the cancellation of their debts, the firm makes the sentences handed down by the Spanish courts available to all interested parties. “It is important to note – explain the firm’s lawyers – that it is often the clients themselves who decide to encourage other interested parties to start the process. They do it through first-person testimony, through videos, or directly. And it is that have benefited from this law and want their acquaintances and relatives as well as family and friends to know the positive results of this mechanism”.Repara tu Deuda Abogados performs an analysis prior to the beginning of the process to verify if it is really necessary to carry out the procedures to benefit from this mechanism. Before starting the procedure, they verify that they really meet the requirements to be able to cancel their debts. In this way, they hope that individuals and the self-employed do not waste time or economic resources if they are not potential beneficiaries. To be worthy of this second chance, there are a series of necessary premises. Thus, it is key that the bankrupt has not committed socioeconomic crimes in the last ten years, that they have acted in good faith -without hiding assets or income- and that the amount of the debt does not exceed 5 million euros.
