A Brooklyn judge Thursday extended the emergency stay blocking President Trump’s immigration ban until Feb. 21 – as lawyers for the American Civil Liberties Union said they believed “200 to 300 people” were still being held.
ACLU lawyers squared off in Brooklyn federal court after a judge issued the stay last weekend – a move prompted by a petition filed by Iraqi men Hameed Khalid Darweesh and Haider Sameer Abdulkhaleq Alshawi, who were detained at JFK Airport under Trump’s new temporary travel ban.
“There needs to be some extension of the [temporary restraining order] for good cause shown,” said Judge Carol Bagley Amon. “I’m going to extend it just until the 21st.”
ACLU attorney Lee Gelernt said the Justice Department still hasn’t turned over a full list of detainees, which he believed could amount to as many as 300.
“We still have not received confirmation that no one is being detained,” he said. “We have evidence that others were removed.”
That prompted Amon to ask Samuel Go, who represents the Justice Department, whether people wer still being held at airports.
“From our understanding, no,” he replied.
