A Chicago man suspected of knocking out a Mag Mile drink server in a downtown street minutes before a cab driver accidentally ran over and killed the unconscious man nearly a year ago is back in Illinois after being extradited from Minnesota following a recent arrest there.

Before a Cook County judge on Friday, prosecutors formally executed the arrest warrant for aggravated battery against Marcus Moore, who authorities believe was the person captured on surveillance videos punching Marques Gaines outside a 7-Eleven store near the corner of State and Hubbard streets early on the morning of Feb. 7, 2016.

The punch sent Gaines, a popular server at the Chicago Marriott Downtown Magnificent Mile, sprawling to the gutter outside the 7-Eleven following an altercation outside the store where he had stopped to buy chips.

Prosecutors did not offer up a proffer of details laying out their case against Moore, but a judge ordered the 6-foot-4-inch, 300-pound man held on $50,000 bail.

It’s unclear whether Moore will face more serious felony charges related to Gaines’ death, though Cook County prosecutors often convene grand jury inquiries within weeks of formally charging a suspect.

Minneapolis police arrested Moore on Jan. 23 on a felony warrant out of Chicago, but was returned to Illinois this week after he waived extradition, officials said.

The story of Gaines’ death later gained international attention when surveillance video of the attack — released to the Tribune last April by attorneys for Gaines’ family — showed not only the assault but also two people who approached and appeared to rifle through the unconscious man’s pockets. The footage also shows more than a dozen bystanders failing to come to Gaines’ aid in the nearly two minutes before a cab accidentally drives over him. He was pronounced dead at Northwestern Memorial Hospital.

Moore, whose last known local address was the Pacific Garden Mission in the South Loop, is expected to return to court next week.
