The Court of First Instance and Single Investigation of Cazalla de la Sierra (Seville, Andalusia) has issued the Benefit of Exoneration of Unsatisfied Liabilities (BEPI) in the case of a man who has thus been freed from a debt that amounted to 38,630 euros, thanks to the Second Chance Law. SEE SENTENCEThe exonerated person went to Repara tu Deuda, the first office that applies the Second Chance Law in Spain, in a situation of economic suffocation due to the state of over-indebtedness in which he found himself. As the firm’s lawyers explain, his case is as follows: “his insolvency arose when he requested financing to pay for necessary dental treatment. At first he had no problems paying the installments. Unfortunately the debtor was diagnosed with an illness, so he was in a long period of sick leave, with the consequent reduction in his income. During this period he had no choice but to apply for credit cards for his own consumption and to be able to survive. As a result of the pandemic caused by COVID-19, he was forced to be in ERTE, which left him even more diminished. Once his case had been analyzed, the lawyers of Repara tu Deuda began the procedures so that the bankrupt could benefit from the Second Chance Law. Once the process is completed, the man is freed from 100% of his debts. At this time, the number of people who have put their case in the hands of the legal office exceeds the figure of 20,000 individuals and self-employed persons. The reality is that this law is increasingly known in many Spanish households who have seen in this tool the real solution to all their debt problems. Thanks to the approval of the Second Chance Law in 2015, the firm has managed to overcome the figure of 180 million euros exonerated to its clients, who come from the different autonomous communities. The profile of those exonerated is very diverse: parents who guaranteed their children for the purchase of an apartment, self-employed people who started a business or who made investments with a negative result, individuals who have been victims of some type of deception, unemployed or in complicated work or health circumstances, etc. The lawyers at Repara tu Deuda, specialists in the Second Chance Law, point out as keys to success “having the best lawyers in this tool, using optimal technology and never forgetting the human factor, so important in a very distressing process for many.” The Second Chance Law allows both individuals and the self-employed to be exonerated from their debts. For this to be possible, it is necessary to meet a series of requirements such as that the bankrupt acts in good faith, that the amount owed does not exceed 5 million euros and that he has not been convicted of socioeconomic crimes in the last ten years. Since September 2022, it is not necessary to try to reach a payment agreement with banks and financial entities. For those who cannot use the Second Chance Law, the firm offers to analyze the contracts signed with banks and financial entities. Along these lines, the objective is to check if there are abusive clauses for the cancellation of credit cards, revolving cards, mini-credits, loans and mortgages and thus be able to claim from Cofidis, Moneyman, WiZink, Carrefour, Vivus, Banco Santander, CaixaBank, BBVA, Banco Sabadell, myKredit, Kviku, etc.
