On June 26, deputies and senators had just heard on the last couple of points which divide in a mixed joint commission (CMP), which explains the return of the bill to the two chambers. The agreement found in the CMP should enable the rapid adoption and the final text that carries and defends hard-won Bercy since January, despite worries and threats from Washington, which considers that the tax will be “extremely discriminatory against multinational corporations based in the United States”.

A tax of 3% on the sales turnover in France

After several failures of the negotiations for the implementation of this tax at the european level (veto Iceland, Denmark, Sweden and Finland), France has therefore developed a tax-habs on the giants of the digital world. It takes a however, in large lines, the one proposed by the european Commission, i.e. a fee of 3% on the turnover. Some neighbouring countries have already put in place (such as Spain or the United Kingdom). A “first step” in the implementation “of a tax XXIé century, on which everyone agrees to say that it is time to act”, presents Bruno Le Maire. The latter can count on the support of the president of the Republic, who had made the tax Gafa a horse of battle in his speech in response to the “yellow vests” in December 2018.

The companies affected by this tax of 3% will be those that perform more than 750 million euros of turnover in the world and 25 million on the French soil. Only companies offering online advertising, the sale of goods or activities of platforms for intermediation, will be covered.

According to the firm legal and tax Taj, this are 26 companies in the territory that meet these criteria and who will have to pay this tax, retroactive to January 1, 2019. There are of course the giants who lend their initials to the acronym Gafa, i.e. Google, Amazon, Facebook and Apple, but also Ebay, Rakuten, Wish, Zalando or even Microsoft and Twitter. On the French side, Criteo should also be concerned.

A tax is ephemeral, which is expected to bring in between 400 and 650 million euros per year

For the year 2019, it is expected that the tax Gafa reported 400 million euros to the coffers of the State, to believe in the tenant of Bercy. And the figure could reach 650 million by 2021. With regard to the $ 60 billion generated by the corporate tax, this tax shows, for some, appearance is more political than budgetary.

In addition, it should only be temporary. It will be set up in the expectation of an international agreement within the Organization of economic cooperation and development (OECD). To do this, it would be important that all countries come to hear, and that could well happen as early as next year. Therefore, France would withdraw “of course its national fee”, recently assured Bruno Le Maire. Also note that as of 2020, the government will submit to Parliament a report on the results of the tax and prior to September 30 of each year.
