Those who refused military service in Syria and are now seeking protection in Germany, must be granted refugee status. This was decided by fifth Senate of Saxon Supreme Administrative Court in Bautzen in several judgments. In explanatory memorandum, it was said, among or things, that y were threatening ir homeland political persecution.

In procedures to be negotiated, Federal Office for Migration and Refugees (BAMF) had only granted subsidiary protection to Syrians, which resulted in restrictions on family reunification. On or hand, people concerned complained before administrative courts of Chemnitz, Leipzig and Dresden. But y came to different judgments.
In contrast to subsidiary protection, refugee status presupposes that those affected should not only expect state persecution, but that y are really threatening m. This was case for conscientious objectors, because y were treated as opposition by Syrian authorities, Supreme Administrative Court judged.
The question is disputed in case law of Supreme Administrative courts and courts of federal states. A revision of federal administrative Court was not permitted. However, parties can now appeal.
