A subsidiary of a Bethlehem company will get $12.5 million in the settlement of litigation involving patent infringement and breach of contract related to DNA collection kits, according to a news release.

The agreement between OraSure Technologies Inc.’s subsidiary DNA Genotek Inc. and Ancestry.comDNA LLC ends federal lawsuits in Delaware and California, Bethlehem-based OraSure said.

Both sides will seek to end proceedings involving DNA Genotek’s property at the U.S. Patent and Trademark Office, the news release said.

Ancestry will get a license to use DNA Genotek patents and patent applications for the collection of human DNA in saliva, OraSure said. The agreement is limited to Ancestry’s genetic testing services. DNA Genotek will get access to patents used in Ancestry’s current DNA collection kit, OraSure said.

“We are pleased to have resolved this litigation,” Douglas A. Michels, president and CEO of OraSure, said in the news release. “We are committed to innovation and the creation of new products and solutions for customers in the markets that we serve. An important part of this commitment is the protection of our technology and products and we will remain vigilant in seeking to enforce our intellectual property rights where needed.”

OraSure produces diagnostic and collection devices such as rapid tests for HIV and HVC.
