A 33-year-old Texas man caught on Interstate 90 near Elgin with nearly 26 pounds of marijuana has pleaded guilty and was sentenced to seven years in prison. Daniel Cuellar, of Donna, also must pay a $30,000 drug fine after pleading guilty to possession of more than 5,000 grams of marijuana with intent to deliver Friday, according to Kane County court records.
Cuellar was eastbound on I-90 near Route 31 in early April 2016 when he was cited for improper lane use and failure to signal, authorities said. Kane County sheriff’s deputies smelled an odor of marijuana coming from Cuellar’s 2004 Dodge Durango and seized 11,700 grams of marijuana, or about 25.8 pounds, worth an estimated $200,000, in two travel bags.
Cuellar gets credit for seven months served at the Kane County jail, where he was held on $100,000 bail since his arrest.
Under state law, Cuellar can have his sentence cut in half for good behavior.
Judge D.J. Tegeler accepted the guilty plea. Cuellar faced a sentence of six to 30 years in prison.
